Reef Technologies invites you to review our terms and conditions. We value openness, so all of our terms and conditions are listed below to help you understand our policies.
Interpretation
The following criteria determine the meanings of words whose first letter is capitalised. Regardless of whether they are used in singular or plural, the following meanings will have the same meaning.
Web Hosting Agreement And Terms Of Service
To register with us and use our hosting services, you must adhere to Reef Technologies' regular policies and terms & conditions. Before utilising our services, please make sure you have read and accepted these conditions.You can reach us at any moment if you have any questions.
The terms and use rules are subject to modification at any time by Reef Technologies. Every client's safety and security are our top priorities.
Change in Packages and Pricing
Reef Technologies maintains the right at any time to modify the costs and features of its products and packages. Our website's pricing and service details are subject to change at any time without prior notice. Reef Technologies alone has the authority to raise prices, and all new agreements and orders will be subject to the updated rates. Orders placed prior to the announcement of the changed prices will continue to be fulfilled at the previously negotiated rate; the updated pricing will only apply to new purchases
What You Own and What You Do Not Own
Web Server
If specified in the proposal or email sent by the Reef Technologies sales team, clients receive free web hosting as part of the package. Reef Technologies retains ownership of the hosting infrastructure, which is only used for website upkeep and operation.
Content Management System (CMS)
This is not owned by the clients. A web application for content management and administration on websites. The creators, Reef Technologies, own the CMS and its software, and you are only allowed to use it while your website is hosted and maintained on our server
Database Software
This is not owned by the clients. Database programs like MySQL, which are developed and maintained by Reef Technologies, are neither owned nor accessible by clients. However, as long as the content is developed or supplied by the customer, they own ownership of the website data and content that is maintained in the database.
Source Code (Custom Programming)
This is not owned by the clients. The basic functionality, system integrations, and connectors to other server software are all included in the web server platform language coded code created by Reef Technologies. Additionally, this source code may communicate with third-party services and external connected systems. HTML, CSS, and JavaScript are created by the backend source code and rendered in the browser to show the user interface of the website.
Visual Design
This is owned by the clients. The user interface and understandable content of a website are created by combining layout with presentable graphical elements including colours, photographs, typography, photos, and videos. The information required to show these assets so that the browser can correctly render the website on the screen is contained in the HTML, CSS, and JavaScript files. Reef Technologies offers its clients a contract that, upon project completion and full payment, grants ownership of the website's visual design
Text Content
Customers Own This. The browser renders the prepared, legible, search engine indexable, and copy pasteable webpage text. If any text on a website is written by the client or their staff on behalf of Reef Technologies projects, the client will be the owner of such content
Photography
If the photos were taken by clients, they are the owners. If a digitised photograph was taken or supplied by the client or their staff, it will remain the client's property. This includes images used in logos, user interfaces, slideshows, galleries, films, and other visual design elements. Reef Technologies does not assert ownership of photographs supplied by clients
Domain Name
Even if a domain name is registered in a client's name, they do not actually own it. The unique web address used for website access and branding is called a domain name. Subject to the terms and limitations set forth by the domain registrar, registering a domain only gives the client the exclusive right to use it.
Reef Technologies may continue to oversee domain administration and associated configurations for operational and security reasons as long as the website is managed and hosted by Reef Technologies. In compliance with applicable policies, domain access or transfer help may be given to the client upon request and following payment of all outstanding balances.
Legal Reality of Website Ownership
Clients do not own backend systems, CMS, hosting, or platform technology. Reef Technologies provides a licensed system for usage.
Clients only own:
Final HTML/CSS/JavaScript.
Visual design
Content (text/images provided by the client)
Conclusion
Reef Technologies will not share backend source code, CMS, database files, or hosting credentials.
If services are discontinued, clients may take control of their domain (if purchased through us) after
clearing all dues.
We do not provide backend system access or source code, including CMS and database backups.
Web Hosting Details
In order to preserve system performance and security, hosting credentials are kept private from
customers. When appropriate, hosting is offered as a free service.
In order to preserve stability and security, Reef Technologies may limit the installation of third-party
applications or plugins.
Domain Details
Only upon explicit request and customer acceptance of liability for any future problems resulting from modifications may domain credentials be given.
Working on Client’s Server
Web apps, websites, and portals created by Reef Technologies are not hosted on the client's server
by us.
The prices and services listed on our website are subject to change at any time and without previous
notice. Reef Technologies will be the only one to decide whether to raise prices. Only new deals will
be subject to the updated pricing; orders placed prior to the announcement will still be subject to the
prior pricing structure.
Setting Up an Account
Only after Reef Technologies has received and verified your payment and finished the required screening processes will your account be authorised. For the purpose of verification, it is the client's obligation to supply true and reliable information. Account activation may be delayed if this isn't done.
Definitions
In accordance with these terms and conditions:
An affiliate is an organisation that controls, is controlled by, or shares control with a party; "control" is
defined as possessing at least 50% of the shares, equity interest, or other securities that have the
right to vote on the election of directors or other management authority.
The term "country" refers to India.
Reef Technologies is referred to in this Agreement as "the Company", "We", "Us", or "Our".
The term "device" refers to any gadget—such as a computer, smartphone, or tablet—that has access
to the service.
The website and any associated services offered by Reef Technologies are referred to as services.
The whole agreement between You and the Company regarding the use of the Service is made up of
these Terms and Conditions, generally known as "Terms.
Any services or material (including data, information, goods, or services) supplied by a third party that
the Service may display, incorporate, or make available is referred to as a third-party social media
service.
Reef Technologies' website, which may be accessed through its official domain.
You refer to the person using the service, the business, or any other legal entity that the person is
using the service on behalf of, if applicable
Links to Other Websites
Links to websites or services that are not owned, run, or controlled by Reef Technologies may be
found on our service.
The content, privacy policies, and practices of any third-party websites or services are beyond Reef
Technologies' control and are not its responsibility. You understand and accept that Reef
Technologies will not be held accountable or liable, either directly or indirectly, for any loss, damage,
or problems resulting from or related to the use of or reliance on any such products, services, or
content available on or through those third-party websites or services.
Any third-party websites or services you visit should have their terms and conditions and privacy
policies reviewed
Termination
For any reason, including but not limited to a breach of these Terms and Conditions, we reserve the right to immediately, without prior notice or liability, suspend or terminate your access to our services. Your ability to utilise Reef Technologies' services will immediately end upon termination
Limitation of Liability
The total liability of Reef Technologies and any of its service providers under any provision of these
Terms and your exclusive remedy for all of the aforementioned shall be limited to the amount actually
paid by You through the Service, or USD 100 if You have not made any purchases through the
Service, regardless of any damages You may incur.
Reef Technologies and its service providers shall not be liable for any special, incidental, indirect, or
consequential damages of any kind (including, but not limited to, damages for loss of profits, loss of
data or other information, business interruption, personal injury, loss of privacy, or any other loss
arising out of or in any way related to the use of or inability to use the Service, third-party software,
third-party hardware, or otherwise in connection with any provision of these Terms), even if Reef
Technologies or any service provider has been informed of the possibility of such damages and even
if the remedy fails to serve its primary purpose.
Some of the aforementioned restrictions might not apply to you because some countries do not
permit the exclusion or limitation of liability for incidental or consequential damages. Each party's
responsibility in these situations will be restricted to the greatest degree allowed by the relevant
legislation
Disclaimer of Warranties – Reef Technologies
You receive the service "AS IS" and "AS AVAILABLE," with any flaws and imperfections, and without any type of warranty.
Reef Technologies, on its own behalf and on behalf of its affiliates, licensors, and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, to the extent permitted by applicable law. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Reef Technologies makes no promises or guarantees regarding:
The service will fulfil your needs or expectations.
The service will produce the desired outcomes.
The service will work with other programs, software, and systems.
The service will function flawlessly.
Any flaws or mistakes will be fixed.
Notwithstanding the aforementioned, neither Reef Technologies nor any of its suppliers make any explicit or implicit representations or warranties about:
(i) The Service's availability or operation, or the data, content, or materials it contains;
(ii) The Service's uninterrupted, safe, or error-free nature
(iii) The completeness, correctness, and dependability of any information or content offered through the Service;
(iv) The absence of viruses, malware, trojans, worms, or other dangerous elements on the Service, its servers, or emails received from or on behalf of Reef Technologies
Limitations on consumer rights or the exclusion of specific guarantees are prohibited in some jurisdictions. Some of the aforementioned exclusions might not apply to you in such circumstances. Nonetheless, the exclusions and limits will be implemented in these jurisdictions to the greatest degree allowed by the relevant legislation.
Governing Law
These Terms and your use of Reef Technologies' services will be governed by Indian law, with the exception of its conflict of law regulations. Additionally, you may be subject to applicable local, state, federal, or international laws when using the application or services.
Severability and Waiver
If any part of these terms is determined to be unlawful or unenforceable, it will be changed and interpreted in a way that best fulfils its intended purpose in accordance with relevant law. The remaining terms of these terms will remain unaffected and in full force and effect.
Unless otherwise specified, neither party's failure or delay in exercising any right, power, or remedy under these Terms shall be interpreted as a waiver of that right, power, or remedy, nor shall any single or partial exercise of any such right preclude the exercise of that right or any other right in the future.
For Reef Technologies, a waiver of one breach will not be interpreted as a waiver of any subsequent violations of the same or any other condition under these terms.
Changes to Terms
These Terms and Conditions may be updated, changed, or replaced at any time at our sole discretion. Reef Technologies alone will decide what qualifies as a material change.
